In a prosecution for attempted first degree assault, second degree assault and unlawful imprisonment in which the Appellate Division reversed the conviction on the grounds that a hearsay statement about the defendant's commission of a similar uncharged crime had been improperly admitted, the Appellate Division is reversed and the case remanded, where the identity exception to the hearsay rule banning evidence of uncharged crimes could apply because the defendant's identity was not conclusively established.
