Court of Appeals of New York

People v. Steward, 29

In consolidated appeals of denial of resentencing under the Drug Law Reform Act of 2009, the orders of the Appellate Division are affirmed, where the defendants were not eligible for resentencing because each had a "predicate felony conviction for an exclusion offense," the court holding that the statutory language did not require that the defendants be adjudicated a predicate felon.
