In an appeal from a judgment of the appellate division reversing the trial court's order of suppression, appeal is dismissed where the judgment, although classified as "on the law," was actually predicated upon a mixed question of law and fact and therefore not on the law alone within the meaning of CPL 450.90(2)(a).
