Conviction of defendant for assault in the first degree is modified to assault in the second degree where although the assault involved numerous blows with a sharp instrument, the resulting injuries were superficial and does not constitute proof of serious disfigurement so as to qualify as a serious physical injury predicate for a first degree assault conviction.
