In an appeal from a judgment of the appellate division reversing the trial court's judgment in favor of plaintiff in a CPLR Article 78 challenge to certain remedial programs implemented to clean inactive hazardous waste disposal sites, 6 NYCRR 375-2.8 (a) and 6 NYCRR 375-1.8 (f) (9) (i), judgment is affirmed because the defendant did not exceed its authority or act contrary to the enabling authority in enacting subject regulations.
