In an appeal from a judgment of the appellate division affirming a denial of defendant's motion to dismissing plaintiff's action for alleged violations of NY Executive Law section 63 (12) and General Business Law section 349, judgment is affirmed because the Financial Institutions Reform, Recovery and Enforcement Act (FIRREA) governs the regulation of appraisal management companies and envisioned a cooperative effort between federal and state authorities, such that it does not preempt state claims alleging fraud and violations of real estate appraisal independence rules.
