In an appeal from a judgment of the appellate division reinstating plaintiff's Labor Law sections 240 (1) and 241 (6) claims after summary dismissal by the trial court, judgment is reversed where plaintiff's fall into a trench system in a basement while pouring concrete is not kind of accident that triggers section 240 (1) liability.
