In an appeal from a judgment of the appellate division denying an application to vacate an arbitration award in a breach of commercial contract dispute, judgment is affirmed where although the court erred in imposing the incorrect standard of review, it correctly determined that there was no basis to vacate the award on the ground of the arbitrator's evident partiality.
