In an appeal from a judgment of the appellate division affirming the trial court's reduction of a first-degree robbery charge to robbery in the third degree, judgment is affirmed where a written statement by the defendant threatening that he had a gun and that he would shoot, without further action, was legally insufficient to support a charge of first-degree robbery.
