In an appeal from a judgment of the trial court convicting defendant of criminal possession of a weapon in the third-degree, conviction and sentencing are vacated where the court's erroneously denied defendant an opportunity to explain fully incriminating statements he made while in police custody since the statements were both pertinent and probative.
