Conviction and sentencing of defendant are upheld because the people did not violate defendant's right to a speedy trial, CPL 30.30, by failing to request his presence in New York from federal custody until his federal trial was completed and he began serving his sentence, and where defendant's challenge on the grounds of insufficiency of evidence is unpreserved, while his ineffective assistance of counsel claim is without merit.
