Court of Appeals of New York

People v. Acevedo, 129

In a dispute involving whether a resentencing sought by a defendant to correct an illegally lenient sentence is effective to temporally re-situate the sentence to change the underlying convictions effect as an enhanced predicate, judgment of the appeals court is reversed where the original sentencing date should be the one to be considered for predicate-felony purposes.
