In an insurance dispute involving whether a restructuring of defendant and its related subsidiaries and affiliates authorized by the Superintendent of the New York State Insurance Department precludes plaintiff-policyholders from asserting claims against defendant under the Debtor and Creditor Law and the common law, judgment of the appeals court is affirmed as modified where Superintendent's approval of such restructuring pursuant to its authority under the Insurance Law does not bar plaintiffs from bringing such claims.
