Court of Appeals of New York

DiGiulio v. Gran, Inc., 178

In tort action involving defendant's failure to use an automated external defibrillator (AED) to render aid to plaintiff, judgment of the appellate court is affirmed where plaintiff cannot recover because she failed to raise a triable issue of fact demonstrating that defendants' or their employees' failure to access the AED was grossly negligent.
