In a dispute arising from the dismissal of indictments for Medicaid fraud on the grounds of a Brady violation, judgment by appeals court dismissing state's appeal is reversed because the state has the statutory right to bring an appeal from a dismissal of an indictment in response to a discovery violation, where such dismissal of indictments emanated from CPL 210.20.
