In a dispute involving the effect of a release on summary judgment, judgment of appellate division is affirmed because defendant proffered a prima facie case that the action should be barred on the ground of release and plaintiff failed to raise a triable of fact that the release should be set aside on the grounds of mutual mistake or that the release was not fairly and knowingly made.
