State Farm v. Langan, 40

In an action action by plaintiff seeking a declaration that it was not obligated to provide benefits in connection with the death decedent because as victim of an intentional crime, decedent was not injured as the result of an accident, summary judgment in favor of plaintiff is reversed because the intentional assault of an innocent insured is an accident within the meaning of his or her own policy where this is consistent with the reasonable expectation of the insured under the policy and the stated purpose of the uninsured motorist endorsement.
