Court of Appeals of New York

People v. Hecker, 184

Defendant's conviction for criminal sale of a controlled substance in the third degree is affirmed where the numerical arguments alone advanced by defendant did not give rise to a prima facie case of impermissible discrimination in the jury selection, and thus the trial court properly denied his Batson application.
