In an action seeking a judgment declaring that the Labor Commissioner's new position applying the prevailing wage laws to charter schools was taken in excess of her jurisdiction and that the prevailing wage laws did not apply to charter schools, and seeking an order enjoining the Commissioner from imposing the prevailing wage laws on petitioners, the grant of the petitions is affirmed where charter schools were not public entities and, further, charter agreements were not contracts involving the employment of laborers, workers or mechanics.
