Sykes v. RFD Third Ave. 1 Assocs., 155
In an action claiming that defendant designed the heating, ventilation and air conditioning systems in an apartment building negligently, with the result that plaintiffs' apartment was too cold in winter and too hot in summer, the appellate division's dismissal of the complaint is affirmed where an action for negligent misrepresentation must be dismissed where the complaint does not allege that the misrepresentations were made with knowledge that plaintiffs would rely on them.
