In an action seeking to recover defendant's credit card debt, summary judgment for plaintiff is reversed where: 1) Delaware's tolling provision did not extend the three-year statute of limitations applicable to plaintiff's claim; and 2) applying Delaware's three-year statute of limitation, the instant action should have been commenced not later than 2002.
