Court of Appeals of New York

People v. Kadarko, 54

In a robbery prosecution, the appellate division's order reversing defendant's conviction is reversed where the trial judge informed counsel of the contents of a note received from the jury and that he was specifically withholding the vote counts discussed in the note from counsel until after the jury had retired to resume deliberations, and defense counsel voiced no objection to this procedure either before or after the entire contents of the note were revealed by the judge.
