In an action by Mental Hygiene Legal Services (MHLS) against defendant nursing homes alleging that, because the nursing homes were providing services for mentally disabled residents, MHLS had a right of access to such residents, summary judgment for defendant is affirmed where the Office of Mental Health (OMH) had determined that facilities such as defendants were not subject to OMH licensure.
