Court of Appeals of New York

People v. Brown, 28

In a robbery prosecution, a denial of defendant's motion to withdraw his guilty plea is reversed where defendant provided detailed allegations explaining the duress that he experienced, at the time he entered his plea, based on his fear that his son might not survive an injury, and the trial court thus should have held a hearing on this issue.
