In a personal injury action based on a fall at a construction site, the appellate division's affirmance of the trial court's denial of summary judgment for plaintiff is reversed where plaintiffs made a prima facie showing that defendant violated Labor Law section 240 (1) by failing to furnish adequate safety devices to plaintiff and defendant did not rebut that showing.
