In an Article 78 proceeding challenging the New York Power Authority's (NYPA) determination requiring participants in the Power for Jobs program to elect between the Restitution Benefit and the Rebate Program rather than allowing them to take advantage of both benefits, the appellate division's decision reversing NYPA's determination is affirmed where there was no evidence that the legislature contemplated that manufacturers would be required to choose between the two programs.
