Two questions certified from the 2nd Circuit are answered as follows: 1) a lawsuit for treble damages may be brought based on an attorney's attempted by unsuccessful deceit; and 2) the costs of defending litigation instituted by a complaint containing a material misrepresentation of fact be treated as the proximate result of the misrepresentation.
