Castillo v. 711 Group, Inc., 74 SSM 42

In a workers' compensation action, denial of summary judgment to dismiss third-party action claiming plaintiff's injuries to his left index finger did not qualify as a "grave injury," but appellate decision to award third-party plaintiff partial summary judgment on the issue whether plaintiff suffered a "grave injury" is affirmed where plaintiff established that he suffered the "loss of an index finger" within the meaning of Workers' Compensation Law section 11.
