In settlement of litigation brought by state, territorial, and DC governments against tobacco manufacturers for wrongful marketing and advertising of cigarettes and other tobacco products, as well as for damages based on the costs of treating smoking-related illnesses, questions whether New York enacted and diligently enforced a Qualifying Statute, requiring manufacturers not participating in the Master Settlement Agreement make annual payments toward the costs of treating smoking-related illnesses, and whether it was correctly spared an adjustment for Non-Participating Manufacturers are arbitrable under the MSA.
