In a prosecution for second-degree murder, an order denying defendant's motion for a Mapp/Dunaway hearing on the ground that defendant failed to present sufficient information to obtain a hearing is reversed based on defendant's factual allegations, including his denying acting as a principal or accomplice, a question of fact regarding the timing of his arrest, and a challenge to the reliability of an alleged witness.
