Court of Appeals of New York

People v. Rowland, 42

In case where Alford plea was basis of conviction and sentences for criminally negligent homicide and weapons possession, and which plea provided that sentences would run concurrent with previously imposed sentences for unrelated crimes, denial of motion to vacate plea is reversed as reduction of the pre-existing sentence nullified a benefit that was expressly promised and was a material inducement to the guilty plea and, thus, it cannot be said defendant would have accepted the plea bargain in the murder case had it not been for his pre-existing sentence in the other case.
