In breach of contract case involving construction of fiber optic telecommunications network, striking of affirmative defenses asserting that Florida law, which enforces pay-if-paid provisions, governs the subcontract, is reversed as parties' choice of law that Florida law would govern contract is enforceable and does not violate New York's public policy as expressed in Lien Law section 34.
