Hoffend & Sons, Inc. v. Rose & Kiernan, Inc., No. 69

Where the facts show that plaintiff, as in any ordinary broker-client relationship, told its insurance agent in general what insurance it had decided to purchase, and the policyholder failed to ask the agent what that specific insurance should be, it cannot seek coverage for a particular loss claimed when neither the policy language nor plaintiff's conduct show otherwise.
