Court of Appeals of New York

Deutsche Bank Securities, Inc. v. Montana Board of Investments, 71

Orders dismissing complaint for lack of personal jurisdiction, and denial of plaintiff's motion for summary judgment, were properly reversed over claims that: 1) there is insufficient basis for the exercise of long-arm jurisdiction; 2) dismissal is mandated by principles of sovereign immunity and comity; and 3) summary judgment is inappropriate because of triable issues of fact regarding insider trading and a need for further discovery.
