Dismissal of petition, seeking review of order by state human rights agency under Executive Law section 298, is reversed where: 1) failure to include a return date in a notice of petition does not constitute a non-waivable jurisdictional defect under section 298; and 2) respondents waived its right to challenge the alleged defect.
