The rule in Matter of Professional, Clerical, Technical Employees Ass'n v. Buffalo Bd. of Educ., 90 NY2d 364 (1997), which allows a public employer to forego its statutory authority to choose any one of three candidates for promotion to clerical and secretarial positions, does not apply to the promotion of police officers.
