Court of Appeals of New York

PEOPLE v. MATEO, 21

Defendant's death sentence must be set aside because he went to trial under an unconstitutional two-tiered penalty scheme. The trial court did not err by admitting his detailed confessions as to three uncharged murders; these admissions were probative of a material issue in the case, and the door was opened by the defense to one degree or another.
