ALAMI v. VOLKSWAGON OF AMERICA, INC., 2 No. 15
A manufacturer of an alleged defective design may not obtain summary judgment dismissal where the decedent was intoxicated at the time of the accident, if triable issues of fact could lead a jury to conclude that any injuries sustained were caused by design defects in the product.
