PEOPLE v. SMITH, 4 No. 2

Where a non-testifying witness' statement was inadvertently included on the back of a trial exhibit provided to the jury, it will not warrant a mistrial when the court provides a strong curative instruction, and overwhelming proof of defendant's guilt renders any error harmless beyond a reasonable doubt.
