Supreme Court of Illinois

Loman v. Freeman, 104289

In a suit for negligence and conversion based upon an allegedly unauthorized surgery on a racehorse that rendered the horse unable to race, dismissal of the complaint is reversed where defendant's duty to perform as a professional veterinarian is independent of his state employment and, therefore, the cause could proceed in the circuit court rather than the court of claims.
