Supreme Court of Illinois

Williams v. Manchester, 104524

In a wrongful death action arising from an automobile accident where plaintiff, pregnant at the time, sustained pelvic injuries, judgment in favor of defendant is affirmed where plaintiff chose to have a therapeutic abortion in order to facilitate repairs to her pelvis and the fetus, was unharmed by the accident, did not have a cause of action at the time of abortion, and thus the parents could not maintain a cause of action for wrongful death.
