Brucker v. Mercola, 102440
In a negligence action arising from defendant-physician selling plaintiff a mislabeled bottle of nonprescription supplements which poisoned plaintiff and her unborn fetus, dismissal of the cause of action under section 13-212(b) of the Code of Civil Procedure is reversed as the eight-year repose period does not begin to run until the infant has a legal right to sue, i.e., when it is born.
