Supreme Court of Illinois
People v. McKown, 102372
In a driving under the influence case, admission of testimony regarding Horizontal Gaze Nystagmus test results is reversed where the trial court and the appellate court erred in taking judicial notice of the general acceptance of the reliability of the HGN test as an indicator of alcohol impairment.
