Supreme Court of Illinois

Mydlach v. DaimlerChrysler Corp., 102588

In a complaint alleging claims under the Magnuson-Moss Warranty-Federal Trade Commission Improvement Act, the judgment of the appellate court reversing the trial court's grant of summary judgment in favor of defendant is affirmed where the claim for breach of repair is not barred by the statute of limitations and can proceed. The appellate court's reversal of the trial court's grant of summary judgment in favor of defendant is reversed where the claim for revocation of acceptance could not be brought against the manufacturer for lack of privity.
