Ultsch v. The Illinois Mun. Ret. Fund, 102232

In an action seeking administrative review of the denial of plaintiff's application for temporary disability benefits which sought to amend her complaint for administrative review to add the Illinois Municipal Retirement Fund Board of Trustees as a defendant, dismissal of plaintiff's complaint is affirmed where section 3-103(2) of the Administrative Review Law did not allow plaintiff to so amend her complaint. The Court declines to reach the question of the constitutionality of Public Act 89-685, which amended section 3-103(2), and vacates the circuit court's order declaring Public Act 89-685 unconstitutional.
