Supreme Court of Illinois

Moore v. Green, 100029

In a wrongful death action where officers responding to the scene of a reported protection order violation did not provide assistance, motion to dismiss is denied, despite claims that the defendant has absolute immunity under Tort Immunity Act, where: 1) the Domestic Violence Act is more specific and more recent; and 2) the DVA's strong wording expresses the intent of the legislature to protect the victims of domestic violence.
