In a pretrial discovery proceeding, a finding of contempt for failing to produce certain records of the defendant's mental-health treatment and alcohol-abuse counseling is vacated where: 1) the Mental Health and Developmental Disabilities Confidentiality Act and the Alcoholism and Other Drug Abuse and Dependency Act contain provisions creating privileges which protect the types of records at issue here from disclosure; 2) it cannot be said that records created before the effective dates of these statutes cannot be protected by them.
