Illinois State Chamber of Commerce v. Filan, 100197

In an action brought challenging the constitutionality of the FY2004 Budget Implementation Act, summary judgment in favor of the plaintiff is reversed and order denying defendants' motion to dismiss is affirmed where summary judgement was precluded by the existence of questions of material fact and plaintiff failed to carry its evidentiary burden because the record was not sufficiently developed.
