In a class action against a tobacco manufacturer, the action was dismissed based on a finding that the defendant-manufacturer engaged in advertising and promotional conduct "specifically authorized by laws administered by any regulatory body or officer acting under statutory authority of this State or the United States" and, therefore, said conduct was exempt from suit under the Consumer Fraud Act.
