Forsythe v. Clark USA Inc., 101570
In a suit attempting to impose liability on a parent company for the wrongful death of two employees killed in a oil refinery fire, summary judgement in favor of the defendant is reversed where "direct participation liability" is a valid theory of recovery under Illinois law and a question of fact had been raised as to whether such liability could be imposed.
